A bench of Supreme Court comprising Chief Justice Ranjan Gogoi, Justice Rohinton Fali Nariman and Justice Sharad Arvind Bobde passed an order for transfer of Assam NRC coordinator Prateek Hajela to Madhya Pradesh on deputation and asked the government to notify his transfer within a week. “We order inter-cadre transfer of Mr. Hajela to the state of madhaya Pardesh on deputation for maximum period permissible under relevant rules/regulations” reads the order.This was very surprising move for those who are fighting for justice in NRC case because despite pressure from political groups as well as various hardcore organizations, Mr. Hajela tried to prepare NRC as per instruction of Supreme Court. Mualana Badruddin Ajmal Qasmi, Member of Parliament and president of Assam State Jamiat Ulema, which has been making all efforts for protection of citizenship of genuine Indians while reacting to this development said: “While the preparation of Assam NRC is at final stage, transfer of NRC Coordinator may put hurdle in preparation of fair NRC. Therefore, we think, whatever may be the reasons, the transfer is unfortunate.”Maulana Ajmal said that Mr. Hajela is a talented and able IAS officer who has been handling matters related to NRC preparation very well. He faced wrath of Assam Govt. as well as Central Govt for not following their instructions. He also refused to meet Assam CM who called him just before publication of final NRC list in August 2019. He made it very clear that he is bond to follow instructions of only Hon’ble Supreme Court and not any governments. The Assam as well as Union Governments complained several times against Mr. Hajela in Supreme Court but he was determined for his mission of NRC preparation. Since the final NRC list was published, he was threatened to his life continuously. Maulana Ajmal further said: “We will continue fighting for justice to the genuine Indian citizens and for preparation of an error free and fair NRC to solve the problems once for all.” We hope that Honorable Supreme Court will have close supervision on preparation of NRC under new officer to be appointed as coordinator of NRC.Although the apex court did not disclose the actual reasons for the transfer as Hajela gave these reports confidentially but there are two reports speculating, (1) governments submitted affidavit in court against Mr. Hajela on the basis of various intelligent report claiming that there are many foreigners in NRC list which is due to Mr Hajela fault, (2) it is said that reportedly the transfer has been done due to threat to Hajela’s life. Whatever may be the reason, one thing is clear the transfer of Mr. Hajela is disappointing.During today hearing, a team of advocates ,engaged by Assam State Jamiat Ulama including Senior Advt. BH Mallappaly,Advt NH Mazarbhuyya, Advt. A. S. Tapader, and Advt. Mansoor Ali was present in the court.
